A. General Terms and Conditions

A1. These terms and conditions form the basis of the hire contract between the Hirer (hereafter “you” or “Hirer”) and Big Country Campers Ltd, 1134 South Street, Glasgow, United Kingdom, G14 0AP (hereafter “us”, “we”, or “Lessor”). Please read this agreement carefully. If there is anything you do not understand please do not hesitate to contact us for clarification.

A2. If any addition to or alteration to these terms and conditions is required, it is preferable that they are confirmed in writing by the parties.

A3. Nothing in these terms and conditions shall be deemed to exclude or restrict the Lessor’s liability for death or personal injury resulting from negligence or any other liability to the Lessor which cannot be excluded as a matter of law.

A4. We reserve the right to alter the rates and conditions at any time. Our website will have the most up-to-date Terms & Conditions.

A5. We will end this agreement immediately and repossess the vehicle if we find out that your belongings have been taken away from you to pay off your debts, or a receiving order has been made against you.

We will also end this agreement and repossess the vehicle if you do not meet any of the conditions of this agreement or have obtained the vehicle through fraud or misrepresentation, or if the vehicle appears to be abandoned. If you are a company, we will also end this agreement immediately and repossess the vehicle if you go into liquidation or you call a meeting of creditors.

If we end this agreement, it will not affect our right to receive any monies we are owed under the conditions of this agreement.

A6. This agreement is covered by the laws of Scotland. Any dispute may be settled in the courts of that country.

B. Booking Terms and Conditions

B1. Booking confirmation charges and payment

The Hirer must pay a booking deposit of 50% to confirm the booking. This deposit contributes towards your total booking cost. By paying this deposit you are accepting these terms and conditions and a binding contract for the hire will come into existence. A booking confirmation/invoice will be sent to you reflecting the rental period and the rental charge. The Deposit must be paid within 24 hours of receiving the invoice.

Your full rental balance is payable four weeks prior to the start date of your hire, or immediately if you book less than four weeks in advance. Failure to make full payment on the date due may result in your booking being canceled. In this event, your initial deposit will be non-refundable. In entering this agreement, you accept (a) to pay all charges due in accordance with the Terms and Conditions of the Hire and (b) that we are entitled to charge any credit or debit card used by you during the hire transaction for payment of any such outstanding charges.

B2. Cancellations & Amendments

All cancellations must be notified in writing.

We do not offer refunds for canceled bookings.

B3. Personal Identification & Licence requirements

All drivers must be between 25 and 75 years and have held a full driver’s license for a minimum of 2 years. All drivers must be present at the time of collection.

In the case of a UK card license, in addition to presenting the card, all drivers must also supply a license “check code” obtained through the Government “View Driving license” website at www.viewdrivingrecord.service.gov.uk

  • No cover is provided if you have had your licence suspended for any period within the last three years.
  • No cover is provided if you have had more than one fault incident within the last three years.
  • No cover is provided if you have more than two convictions with a maximum of three points per conviction.
  • No cover is provided if you have a BA, DD, or UT conviction.
  • Accepted Licence types of Full UK, EU, AU, US, CA, NZ & SA
  • Visitors from outside the UK must produce a valid domestic driver’s license or international driving license as well as a passport.
  • Two, 3-point convictions are acceptable (i.e., 2x SP30s, 3pts each) without a referral.
  • Single 4-point offenses are acceptable without referral and subject to the standard.
  • Single 6-point SP30, SP50, and CU80 convections are acceptable subject to a £2000 excess. All other 6 points+ offenses will require referral to the insurers.
  • Two proofs of address are required from separate sources e.g.
    • Council tax – current year
    • Bank Statement dated in the last 3 months.
    • Credit card bill/statement dated in the last 3 months.
    • Mortgage statement dated in the last 3 months.
    • HMRC self-assessment/tax credit
    • Payslip
    • Mobile Phone Bills dated in the last 3 months.
    • Electricity/Gas/Water (bill/statement) dated in the last 3 months.
 

B4. Insurance 

We provide fully comprehensive insurance with all our hires. The insurance excess is £1000. We will only claim on our insurance policy if we deem this appropriate. For example, a scratch or dent caused by you will not necessarily be claimed via the insurance, you will be liable for any damages caused to the vehicle. A standard charge of £300 will be applied per panel, bumper, or wing mirror if you scratch the vehicle and it requires repainting. Damage to tires or wheels will incur a £250 cost.

Any other types of damage may need a professional quotation for example panel dents or damage to the roof tent.

The insurance is valid for one driver and for the period of the hire from the specified collection date and time to the specified end date and time of return. An additional second driver can be added at the time of booking for a small fee.

The vehicle insurance company does not cover off-road driving accidents, this is not permitted, and you will be held liable in full for any damage caused to the vehicle if it is used for these purposes.

The Road Traffic Act 1988 states that you can drive a vehicle off-road – away from a public road – for the purpose of parking and within fifteen yards of a public road. Landowner permission does need to be sought for private land. Please always use care and caution when driving on uneven surfaces. Operating outside of these guidelines will render the vehicle insurance null and void and therefore you will be personally liable for any damage or theft to the vehicle. You will not be insured and will be personally liable if the vehicle is used for the purpose of off-roading, i.e., driving through rivers/fields/bogs/beaches, etc. If evidence is found via the telematics system or other indicators such as excessive mud and long grass stuck underneath the car your security deposit may be retained until a thorough inspection has been conducted to ascertain if there has been any damage caused.

All our vehicles are fitted with Tracking and telematics technology for insurance purposes.

B5. Vehicle Events Beyond Our Control

Unfortunately, events beyond our control (i.e., events which we could not, even with due care, foresee, or avoid) could affect vehicle availability such as a mechanical breakdown or similar preventing the vehicle from being available for hire on the date booked or during the hire period. We cannot accept responsibility or pay compensation, costs, or expenses where the performance of your contract with us is prevented or affected, or you otherwise suffer any loss because of events beyond our control. However, if you are unable to commence your rental because of such events caused by us then we will offer you a full refund of all monies received for your booking, without further liability.

B6. Storage Of Hirer’s Own Vehicle

The Lessor does not offer storage of your vehicle, you must find suitable options. We can provide a pick-up and drop-off location that is suitable to your needs, be that from an airport, railway station, or reasonable locations around the city of Glasgow. Parking in a public space, if chosen, is at your own risk and the Lessor accepts no responsibility for any damage incurred on your vehicle.

C. Rental Terms & Conditions

C1. In this Agreement, the following terms shall have the meanings hereby respectively assigned them.

Accessories:the add-ons purchased at the point of booking, spare wheel, tools, and other items with which the Vehicle is supplied, and any replacements thereof.Personal – Accident, Personal Effects Goods in Transit Insurance Fees:the fees payable by the Hirer, as set out in the Lessor’s Current Tariff, which entitles the Hirer to the benefits of the Personal Accident, Personal Effects & Goods in Transit cover set out in the Insurance Policy.
Current Tariff: the Lessor’s tariff of charges at the commencement of the Rental Period.Refuelling Charge:the surcharge which is added by the Lessor to the cost of any “top-up’ fuel needed when the Vehicle is returned to the Lessor. Which shall be calculated in accordance with the Current Tariff.
Driver: the Hirer and/or other person named as such, or any other person specifically approved by the Lessor to drive the Vehicle during the duration of this Agreement.Rental Charges:the Vehicle hire charges for the Rental Period, which shall be calculated in accordance with the Current Tariff.
Excess Amount: the fees specified in the contract agreement as the excess amount payable for an insurance claim.Rental Period:the period commencing at the start of the Vehicle hire, as stated in the original contract agreement, and finishing on the redelivery of the Vehicle into the physical custody of the Lessor.
Excess Waiver Fee: the fee, which shall be calculated in accordance with the Current Tariff, which limits the Hirer’s liability to pay the Excess Amount to the amount of the Non-Waivable Excess.Vehicle:the vehicle described in the original contract agreement, and any replacement vehicle.
Hirer:the person named as such in the original agreement.Insurance Policy:the Lessors policy of insurance on the Vehicle, a copy of which is available for inspection at the rental location.
    

C2. On collection of the vehicle a security deposit of £1,000 (equivalent to the insurance excess) is required from you. It must be paid by credit /debit card at least 24 hours before collection/pick-up. We will debit this from your nominated card to the value of £1,000 and hold it in our account.

On collection of the vehicle, we will check for damage and note any that exists, on return, we will do the same, if there is any additional new damage then your deposit will be held until a repair quotation has been sought. Upon this quotation, you will be liable to pay the amount whether it is more or less than the security deposit value.

General wear and tear are excluded such as stone chips to the front of the vehicle. Should no damage be deemed to have occurred we will refund your security deposit within 7 days of returning the vehicle.

C3. Unless otherwise agreed in writing, the vehicle will be available at our collection point in Glasgow on the day of collection at 15:00 PM and must be returned by 11:00 AM on the last day of hire. You should allow up to one hour for the handover on the collection and return. Unauthorised late returns will be charged at the rate of £50.00 per hour for each hour or part thereof that the vehicle is returned late plus any transport or other costs incurred by us in ensuring its safe return.

C4. The Hirer acknowledges that:

  • they shall return the Vehicle and its Accessories to the place and on the date due back, as specified in the original agreement.
  • they will inspect the Vehicle at the point of handover, which is supplied in accordance with the manufacturer’s specification, subject to any qualification or representation contained in any documentation supplied by the Lessor and is satisfied that the Vehicle is in satisfactory condition and is free from apparent defects or damage. Where damage exists, this shall be recorded and acknowledged in the handover paperwork at the point of collection.
  • except where the injury, loss, or damage is caused by the Lessor, the Lessor shall not be responsible for any injury, loss, or damage arising from the Hirer’s use of the Vehicle, nor shall the Lessor be liable for any indirect loss or damage, or, in the case of consumers, damage which was not foreseeable by you and us: and;
  • the Lessor shall not be responsible for injury, loss or damage arising from any defect or mechanical failure which is not attributable to any breach of the manufacturer’s warranty, or any warranty implied by law to take reasonable care or exercise reasonable skill.
 

C5. During the Rental Period, the Hirer shall keep the Vehicle and its Accessories in their possession and shall not allow a third party to take possession of the Vehicle or its Accessories and, when not in use, the Hirer shall keep the Vehicle and its Accessories adequately protected and secured.

C6. The Hirer shall, and shall procure that any Driver shall, ensure that the Vehicle will not be used:

  • for hire or reward.
  • for racing, pace making, rallying, speed testing, driving tuition, or similar purposes or for propelling or towing any vehicle, trailer, or other object.
  • in any manner which might render void the Insurance Policy or other contract of insurance.
  • for any illegal purpose or in contravention of any legislation affecting the Vehicle, its use, or construction.
  • by any person who:
    1. is not licensed to drive the Vehicle.
    2. is under 21 years of age or over 65.
    3. is under the influence of drink or drugs.
    4. has supplied the Lessor with a fictitious name, or address.
    5. has not been approved by the Lessor as a Driver; or
    6. has been convicted of a motoring offense, the details of which have not been disclosed in writing to the Lessor at the commencement of the Rental Period; and
  • outside England, Wales, or Scotland without prior written consent of the Lessor.
 

C7. Mileage – we have no mileage limits applied during your hire. However, if you intend to travel abroad we may require an additional fee to be paid for the extended mileage expected.

C8. Fuel, & Daily Maintenance – Fuel is at your expense. You must ensure that you use the correct fuel (Diesel), and that the vehicle is returned with a similar amount of fuel as was present when it was collected. Any shortfall will be estimated and charged at current rates. It is your responsibility to check basic visual maintenance items such as tyre inflation levels daily and, if necessary, to take appropriate actions to avoid unnecessary damage to the vehicle. If in the unlikely event that the temperature gauge rises above the halfway mark, please stop immediately where it is safe to do so and contact us, driving a vehicle that may be overheating can cause significant engine damage. Normal wear and tear are fine however if you cause damage to the vehicle engine or running gear (Clutch/gearbox/transfer box etc) due to negligence or improper driving then you will be held liable for the cost of the repair.

C9. The Hirer agrees to pay on demand:

  • the Rental Charges, including any add-on costs.
  • any applicable Excess Waiver Fee, and any Refuelling Charge.
  • the Excess Amount in respect of each incident resulting in damage to or loss of the Vehicle, its Accessories, or any property left stored or transported in or upon the Vehicle, save to the extent that such damage or loss arises from the actions of the Lessor.
  • all fines, charges, penalties, costs, and expenses (including all charges and penalty charges incurred under a charging scheme) incurred in relation to the Vehicle by the Hirer during the Rental Period, except where caused through the fault of the Lessor: and
  • any Value Added Tax, local or other taxes payable in respect of any of the above.
 

C10. The Hirer shall be responsible for all losses that the Lessor suffers because of any damage, fire, or theft to or of the Vehicle or its Accessories during the Rental Period (unless caused because of the Lessor’s negligence or the Lessors breach of this Agreement), and this shall include any loss of rental income incurred by the Lessor as a result.

C11. It is illegal to smoke or allow smoking in a hired vehicle in the UK (even with the window open). Any infringement will incur a charge of £100.00 and leave you liable to prosecution and a fine of up to £1000.00.

C12. Breakdowns, Repairs & Accidents – despite regular quality control checks, occasional problems can still arise with the vehicles. In the event of an accident, breakdown or technical difficulties (including problems with tires), you must inform us immediately on the telephone number +447867308791 (leaving a voice or text message if unable to connect). In the event of an accident, the police must be contacted on telephone number 999 and the Lessor must be informed as soon as possible. Third-party demands are not to be agreed to and the police report must include the name and address of the people involved as well as any witnesses, along with all vehicle registration details. Even in the case of minor damage, the Hirer is required to provide a detailed written report to the Lessor outlining the circumstances of the accident.

If the Hirer does not inform the Lessor immediately about the need for a repair and if the Lessor is not given the opportunity to help find a solution, no compensation will be provided. If the Hirer informs the Lessor about any vehicle problems after the vehicle has been returned, but without having informed them during the rental period no compensation will be provided.

If the vehicle is out of action due to a mechanical breakdown (not an accident) for longer than 12 hours, through no fault of the Hirer, the Lessor’s responsibility is limited to refunding the nightly rental rate or portion thereof covering the period from when the fault was initially notified to us until a repair has been completed.

C13. The Hirer and any Driver shall:

  • ensure compliance with the terms, conditions, and limitations of the insurance Policy, which shall be deemed to be included in these terms and conditions as it the same were fully set out herein.
  • inform the Lessor of any loss of or damage to or fault developing in the Vehicle as soon as the Hirer or Driver becomes aware of the loss, damage, or fault.
  • at the request and cost of the Lessor permit to be done in their own name all acts and things as may be reasonably required by the Lessor for the purposes of repairing the Vehicle or enforcing any rights or remedies or of obtaining relief from other parties in respect of any loss or damage to or in connection with the Vehicle or its Accessories.
  • be responsible for any losses, expenses, or other costs incurred by the Lessor by reason of a breach of this Agreement by any Driver.
  • ensure that maximum payload and individual axle-plated weights are not exceeded.
  • be responsible for the loading and unloading of the Vehicle, and
  • obtain or maintain any necessary operator’s license.
 

C14. The Hirer and any Driver shall not:

  • without the prior consent of the Lessor, incur any liability for repairs to the Vehicle or its Accessories more than £25; and
  • make any claim for loss of or damage to any property left stored or transported in or upon the Vehicle unless due to the Lessor’s negligence. The Hirer may purchase insurance to cover such loss or damage by indicating in the relevant box overleaf.
 

C15. Cleaning – if the vehicle is returned in a poor state of cleanliness inside, then additional cleaning charges above and beyond the regular charge may be applied.

C16. The Hirer’s liability will be limited to the amount of the Non-Waivable Excess (as specified in the booking form) if the Hirer pays the Excess Waiver Fee in accordance with the Current Tariff or is part of an inclusive tariff rate offered by the Lessor. Even if an Excess Waiver Fee is paid, the Hirer shall be responsible for payment of any Excess Amount where the loss of or damage to the Vehicle or its Accessories arises from the negligent or wilful action of the Hirer or any Driver.

C17. The Rental Period shall not be extended without the Lessors express authorization in writing and in any event shall not exceed 29 days.

C18. Return of Security Deposit – the Lessor will not make a charge on your card at the end of the hire period provided the vehicle is returned in a satisfactory condition and at the location and date and time agreed. The satisfactory condition includes clean, undamaged, with all tools, accessories, and

If damage charges, including damage repair and replacement, exceed the level or security deposit pre-authorized, you will be liable to cover this, and that sum will be due immediately at the end of the hire.

C19. If the Hirer does not comply with any of the material conditions of this Agreement, they shall return the Vehicle to the Lessor immediately and pay to the Lessor on demand such loss as is recoverable at law where that loss is caused by the Hirer’s non-compliance. Where the Hirer fails to return the Vehicle, the Lessor may retake possession of the Vehicle and all reasonable costs and expenses incidental to the Lessors recovery of the Vehicle shall be paid by the Hirer to the Lessor on demand.
